Separation & Divorce

Separation and Divorce are rarely emotionally easy, even if the new 'no fault' divorce has made the court process easier.  You are not alone if you feel you have a mountain to climb and we're here to help you find your way as quickly and painlessly as possible.

We can provide a full wrap around service for when you want support every step of the way or our assisted divorce service, with minimum input, when just a guiding hand is needed.

Our Divorce Services Start From £250.00 plus VAT plus Court Fee of £593.00 (If you are on low income you may qualify for a fee remission see here.)

If you are not ready to get divorced, or are not married, but wanting to formalise the separation and your finances, our Separation Agreements start from £1200.00 plus VAT.

 

Its also really important that you have an up to date Will to reflect your new circumstances.  Our Wills start from £200.00 plus VAT.

Whilst the actual divorce application process may now be easier, the hard part is still the thorny issue of division of your finances.  Even if you agree on how you will divide your assets, or there isn't much to divide, there must be a final 'clean break' financial order, or you are leaving yourself open to potential claims against you in the future, for instance if your financial situation improves. 

Of course, if you are not in agreement, have lots of assets, a third party may be involved or there is a family farm or business, then matters are not going to be straightforward.  You need early, expert advice and Wildblood Legal have the expertise and experience to help resolve matters as quickly and painlessly as possible. 

We can also act swiftly if you believe assets are being hidden or dissipated, or if you have been left in a difficult financial situation and need an urgent interim maintenance payment or help with your legal fees.

If you think you would like to try mediation then we offer mediation sessions at £200.00 plus VAT per 90 minute session, per person.

It is so often the small people who are forgotton when the big people are struggling to find their way through the raw emotions often experienced during a separation or divorce.  The calmer you and your partner can be when making decisions involving the children, the better will be the outcome for all involved.

The court's position in respect of children is that the parents should try and reach the important decisions themselves without input from the court, but if you simply cannot reach agreement between yourselves and mediation was not successful, then an application to the court will be necessary and Wildblood Legal can  assist you with a Child Arrangement Order.  This might be in respect of who your child spends time with, who they live or it might be in respect of a specific issue, such as schooling. There are also orders available that prohibit certain actions being taken by one parent such as removing a child from the country.

At Wildblood Legal we work to keep matters calm and to encourage you to act in a way that always puts the welfare of your child first.  We would always recommend that mediation is the first thing to try.  Mediation sessions can be child inclusive if the child is of a suitable age and the child is given the opportunity to express his or her wishes in a safe and impartial environment. We would always encourage both parents right from the start, to work together to create a Parenting Plan.  This gives you the opportunity to really think through how arrangements are going to work for you in reality, for day to day, high days and holidays. The CAFCASS website provides a host of useful information in respect of children and separation.

If you are finding it hard to speak to each other then try a Parenting App for your mobile which keeps messages about the children separate and will monitor and block offensive messages. 

Before involving the court it is now a legal requirement to attend a Mediation Information and Assesment Meeting (MIAM) to establish whether you and your partner could resolve your difficulties with the help of a mediator. (If you have already tried mediation you will not need to attend a MIAM). Our MIAM sessions are £100.00 plus VAT per person.
